BASIC PROVISIONS
2.1. Issues not regulated in these GTC, as well as the interpretation of these GTC, shall be governed by Hungarian law, with particular regard to Act V of 2013 on the Civil Code ("Civil Code") and Act CVIII of 2001 on certain issues of electronic commerce services and information society services (Elker. tv.), as well as Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses. For special products, the relevant sectoral legal provisions shall apply. The mandatory provisions of the relevant laws shall apply to the parties without separate stipulation.
2.2. These GTC are effective from February 11, 2025, and shall remain in force until revoked. The Service Provider shall publish any amendments to these GTC on the website and shall notify registered/or previously purchasing Users of the changes by email. Amendments do not affect contracts concluded previously, i.e., amendments do not have retroactive effect.
2.3. The Service Provider reserves all rights regarding the website, any part thereof, the content displayed thereon, and the distribution of the website. It is prohibited to download, electronically store, process, and sell the content displayed on the website or any part thereof without the written consent of the Service Provider (except for this document and the data management policy).
2.4. The Service Provider assumes no responsibility for the sale or purchase of products published on other websites not attributable to or operated by the Service Provider.
REGISTRATION / PURCHASE
3.1. In the event of providing untrue data or data attributable to another person during the use/ordering/subscription of the service, the resulting electronic contract may be challenged by the authorized party before the court. As a result of a successful challenge (winning the case), the contract becomes invalid from the date of its conclusion, or if it conceals another contract, the rights and obligations of the parties shall be judged based on the concealed contract.
3.2. The Service Provider shall not be liable for any delivery delays or other problems or errors due to incorrect and/or inaccurate data provided by the User. However, the Service Provider informs Users that after consultation and clear identification with the User, incorrectly entered data can be corrected in the order to avoid obstacles in invoicing and delivery.
3.3. The Service Provider shall not be liable for damages resulting from the User forgetting their password or it becoming accessible to unauthorized persons for any reason not attributable to the Service Provider (if there is registration on the site).
SCOPE AND PRICES OF PRODUCTS AND SERVICES AVAILABLE FOR PURCHASE
4.1. The displayed products can be ordered online (in some cases by phone) from the webshop. The prices displayed for the products are in HUF, gross prices (i.e., they include the VAT required by law, or if the Service Provider invoices without VAT, the prices are the amounts to be paid), but do not include shipping and payment fees. No separate packaging fee will be charged, unless the User requests decorative or other special packaging.
4.2. In the webshop, the Service Provider meticulously indicates the name of the product, its description, and displays a photo of the products (if possible).
4.3. If a promotional price is introduced, the Service Provider shall fully inform Users about the promotion and its exact duration. The Service Provider acts lawfully when determining promotional prices, complying with the rules of joint decree 4/2009 (I. 30.) NFGM-SZMM on the detailed rules for displaying the selling price and unit price of products, and the fees for services.
4.4. In case of an incorrectly displayed price, the Service Provider is not obliged to confirm the order at this price, but has the option to reject the offer and may offer confirmation at the correct, real price, in which case the User has the right to
- not accept the modified offer, cancel the order.
- maintain their order at the correct price.
According to Act V of 2013 on the Civil Code (Ptk.), a contract is concluded by the mutual and concordant expression of the will of the parties. If the parties cannot agree on the contractual terms, i.e., there is no declaration mutually and concordantly expressing the will of the parties, then there can be no validly concluded contract from which rights and obligations would arise.
Incorrect prices include
- 0 HUF,
- 1 HUF, or
- promotional prices that do not correspond to the stated percentage discount compared to the original price. For example, if the original price of a product is HUF 10,000 and there is a 50% discount, the correct promotional price would be HUF 5,000. An incorrect price would be if HUF 1,000 or HUF 2,000 appears instead.
ORDER PROCESS
5.1. After registration, the User logs into the webshop/or can start shopping without registration.
5.2. The User sets the quantity of the product(s) they wish to purchase.
5.3. The User adds the selected products to the cart. The User can view the contents of the cart at any time by clicking on the "cart" icon.
5.4. If they do not wish to purchase any further products, they check the quantity of the product(s) to be purchased. The User can delete the contents of the cart by clicking on the "X" icon. To finalize the quantity, the User clicks on the "+/-" icon.
5.5. The User enters the delivery address, then the delivery/payment method, the types of which are as follows:
5.5.1. Payment methods:
Bank transfer in advance: The consideration for the order can be settled by bank transfer in advance, in Hungarian Forints or Euros. The proforma invoice containing the data necessary for payment will be sent to the Customer by email after the order confirmation. In case of payment in Euros, the amount will be determined based on the MNB (National Bank of Hungary) central exchange rate valid at the time of issuing the proforma invoice.
Cash on delivery (up to HUF 500,000 order value): In case of home delivery, the consideration for the order can be settled with the courier upon receipt. Cash on delivery is available for a handling fee of HUF 4,990, which will be added to the total order amount. Cash on delivery is not available for orders over HUF 500,000.
Personal pickup and payment: Personal pickup of the product is possible by prior arrangement. If the Customer settles the consideration for the order not by advance bank transfer, but upon pickup, in cash or by on-site bank transfer, a handling fee of HUF 4,990 will be charged. If the order amount is settled by advance bank transfer before pickup, no separate handling fee will be charged.
5.6. The final amount payable, based on the order summary and confirmation email, includes all costs. The User is obliged, pursuant to Section 6:127 of the Civil Code, to verify without delay whether the quality and quantity of the ordered product(s) are appropriate. The delivery of the product(s) takes place on weekdays between 8 AM and 5 PM.
5.7. After entering the data, the User can send their order by clicking the "order" button, but before that, they can re-check the entered data and also send a comment with their order, or notify us by e-mail of any other wishes related to the order.
5.8. By placing the order, the User acknowledges that, according to Section 15 of Government Decree 45/2014. (II. 26.) and other conditions (e.g., Section 20), they incur a payment obligation with the order.
5.9. Correction of data entry errors: Before completing the ordering process, the User can always go back to the previous phase where they can correct the entered data. In detail: During the order, it is possible to view and modify the contents of the cart; if the cart does not contain the desired quantity, the User can enter the desired quantity in the data entry field in the quantity column. If the User wishes to delete products from the cart, they click on the "X" button. During the order, the User has a continuous opportunity to correct/delete the entered data. The User also has the option to request the correction of any errors by phone or e-mail after sending the order.
5.10. The User will receive a confirmation email after sending the order. If this confirmation does not arrive to the User within an expected period of time depending on the nature of the service, but at most within 48 hours from the sending of the User's order, the User is released from the offer's binding nature or contractual obligation. The order and its confirmation are considered received by the Service Provider or the User when they become accessible to them. The Service Provider excludes its liability for confirmation if the confirmation does not arrive in time because the User provided an incorrect e-mail address during registration or cannot receive messages due to the mailbox associated with their account being full.
5.11. The User acknowledges that the confirmation mentioned in the previous point is merely an automatic confirmation and does not create a contract. The contract is concluded when the Service Provider, after the automatic confirmation mentioned in the previous point, notifies the User in a new email about the details of the order and its expected fulfillment.
5.12. Special provisions
Special provisions applicable to businesses:
This regulation applies to Customers who are not consumers (businesses). If a business decides after the completion of an order that it does not wish to accept the product or cancels the order, it incurs a penalty payment obligation.
- The amount of the penalty payment is 10% of the total order amount, which the Seller is entitled to enforce after the cancellation.
- Refund of the advance payment or full purchase price will only take place after the deduction of the penalty payment.
- By financially completing the order, the Customer accepts that in case of cancellation or non-acceptance, they are obliged to pay the penalty payment.
The Seller reserves the right to enforce further costs based on the conditions specified in the General Terms and Conditions if the breach of contract demonstrably causes damage to them.
Warranty and Guarantee:
According to these General Terms and Conditions, the Seller regulates the warranty and guarantee obligations for products as follows:
Warranty
The Seller provides a warranty to the Customer for products for which mandatory warranty is prescribed by current legislation. The warranty period begins on the day of product purchase and can be enforced according to the manufacturer's or distributor's warranty conditions for the given product.
The detailed terms of the warranty, any exclusions, and the method of enforcing the warranty are contained in the warranty card or other manufacturer's documentation accompanying the product. The Seller is only obliged to assess and fulfill warranty claims that are prescribed by current legislation or provided by the manufacturer or distributor.
Heat pumps and other products requiring installation
The Customer acknowledges that the commissioning of certain products – especially heat pumps and other equipment requiring installation – ensures proper operation only with professional installation.
In the case of these products, the responsibilities are divided as follows:
- The Seller only sells and delivers the product in perfect condition to the Customer.
- Installation and commissioning are carried out by a qualified professional commissioned by the Customer, for which the Seller assumes no responsibility.
- During the commissioning of the product, the commissioning professional is obliged to check the proper operation of the equipment.
- By carrying out the commissioning, the professional assumes responsibility for the installation and the operational capability of the system.
- The Seller is solely responsible for the sale of the product and for providing the warranty according to the laws, but assumes no responsibility for installation and commissioning works.
Transfer of liability
The Customer expressly acknowledges and accepts that the proper installation and commissioning of the product can only be carried out by a qualified professional.
The Seller assumes no responsibility for faults and damages resulting from incorrect installation, unprofessional commissioning, or improper maintenance of the product. The professional responsible for commissioning is solely responsible for fulfilling installation and commissioning obligations and for the operational capability of the system.
During installation work, the professional is obliged to comply with all relevant technical regulations, safety requirements, and manufacturer's instructions. The Seller assumes no responsibility for omissions and malfunctions resulting from these.
Disclaimer – Content and technical data:
Product descriptions, technical data, and images found on the Seller's website are for informational purposes only. The information published on the website does not constitute official technical documentation and cannot be used for design, construction, or other technical purposes.
Regarding the technical parameters of the products, the data officially provided by the manufacturer shall always be considered authoritative. The Seller assumes no responsibility for any deviations or damages resulting therefrom, including problems arising from inadequate design or construction.
The Customer is obliged to consult the current technical documentation, data sheets, and installation guides issued by the manufacturer before making a final decision and, if necessary, to consult with a professional.
Warranty administration and servicing
The warranty conditions provided by the manufacturer apply to the products we distribute. Warranty repair and replacement processes are always handled according to the official procedure of the respective manufacturer.
If, during warranty administration, the manufacturer requires the product to be returned (e.g., smaller electronic equipment, inverters, controllers, etc.), the faulty product must be sent to the manufacturer's designated service center for inspection. Depending on the outcome of the inspection, repair, replacement, or return of the product may occur. In these cases, the lead time specified by the manufacturer – which can be several weeks – is part of the administrative process.
We draw our customers' attention to the fact that not all manufacturers provide temporary replacement equipment for the duration of inspection and repair, so temporary replacement of faulty products is not always possible.
It is important to note that in the case of some larger systems (e.g., heat pumps), the repair process typically takes place on-site through inspection and service; in such cases, it is not necessary to return the device.
The customer acknowledges that the duration of the repair or replacement process depends on the manufacturer's service capacity and procedures, and the distributor cannot be held responsible for any downtime, production loss, or other indirect damages resulting therefrom.
Our company always acts in accordance with manufacturer's regulations and current legislation and strives to ensure the shortest possible administrative time.
Rules for commissioning, installation, and return
Products that have been unpacked, installed, commissioned, or connected to any system (electrical, hydraulic, mechanical/structural) after purchase incur a depreciation in value, and therefore cannot be resold as new. The business is only authorized to sell new, unopened, uncommissioned products, so we are unable to accept returns or exchanges of products that have been used or commissioned in this manner.
The term "installation" refers to any operation during which the product is physically fixed, connected, or commissioned at its final place of use, including, but not limited to, connection to the electrical network, water or heating system, and other structural fixings.
The start date of the warranty (guarantee) is the day of commissioning. Commissioning is considered to have occurred when the product has been connected to a system, connected to a power or water supply, or put into operation according to the manufacturer's instructions in the manner necessary for its intended operation.
ORDER PROCESSING AND FULFILLMENT
6.1. Orders are processed on business days during business hours, in the order of their arrival. Orders can be placed outside of the times designated for order processing; if placed after business hours, they will be processed on the next business day. The Service Provider's customer service will always confirm electronically when they can fulfill the order.
6.2. The general fulfillment deadline is within 2-5 business days from the conclusion of the contract.
6.3. Based on the sales contract, the Service Provider is obligated to transfer ownership of the item, and the User is obligated to pay the purchase price and take delivery of the item.
6.4. If the seller is a business and the buyer is a consumer, and the seller undertakes to deliver the item to the buyer, the risk of damage passes to the buyer when the buyer or a third party designated by them takes possession of the item. The risk of damage passes to the buyer upon delivery to the carrier if the carrier was commissioned by the buyer, provided that the carrier was not recommended by the seller.
6.5. In case of delay by the Service Provider, the User is entitled to set an additional deadline. If the seller fails to perform within the additional deadline, the buyer is entitled to withdraw from the contract.
6.6. The User is entitled to withdraw from the contract without setting an additional deadline if
a) the Service Provider has refused to perform the contract; or
b) the contract should have been performed by agreement of the parties or due to the discernible purpose of the service at the specified time of performance - and not at any other time.
If the Service Provider is in default, the User may demand performance, or if their interest in the performance of the contract has ceased due to the default, they may withdraw from the contract.
The User is not required to prove that their interest in performance has ceased if
a) the contract should have been performed by agreement of the parties or due to the discernible purpose of the service at the specified time of performance - and not at any other time; or
b) the authorized person has set an appropriate additional deadline for subsequent performance, and the additional deadline has passed unsuccessfully.
6.7. If the Service Provider fails to fulfill its contractual obligation because the product specified in the contract is not available, it must immediately inform the User of this, and immediately refund the amount paid by the User. Furthermore, the Service Provider must ensure that the User can enforce their other rights provided by law in case of faulty performance.
6.8. The Service Provider draws the attention of Users that if the User does not take delivery of the ordered product(s) performed in accordance with the contract (regardless of the payment method), they commit a breach of contract, specifically they fall into default according to Section 6:156 (1) of the Civil Code.
This means that the Service Provider, based on the rules of management without mandate – if the Consumer does not indicate their intention to withdraw (and does not make a statement whether they wish to take delivery of the ordered product(s)) – will assert the usual storage costs associated with the product(s) and the shipping cost (and the cash on delivery fee, if any) (round trip) against the Users.
The Service Provider draws the attention of Users that in order to enforce its legal claims arising in this way, it will use the assistance of its lawyers, and therefore other (legal) costs arising from the breach of contract (including the fees for payment order procedures) will also be borne by the User.
RIGHT OF WITHDRAWAL
7.1. Pursuant to Directive 2011/83/EU of the European Parliament and of the Council, and Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses, the Consumer has the right of withdrawal without stating reasons.
The consumer may exercise their right of withdrawal or termination
a) in the case of a contract for the sale of goods

ad) if the product is to be delivered regularly within a specified period, from the day of the first delivery,
by the consumer or a third party designated by them, other than the carrier.
If the Service Provider fails to comply with this information, the 14-day withdrawal period will be extended by twelve months. If the Service Provider provides the information after the expiry of 14 days from the date of receipt of the product or the conclusion of the contract, but within 12 months, the withdrawal period will be 14 days from the communication of this information.
7.2. The Consumer may exercise their right of withdrawal with a clear statement to this effect, or using the declaration sample specified in Annex 2 of Government Decree 45/2014. (II.26.).
7.3. The period for exercising the right of withdrawal expires 14 days after the day on which the Consumer or a third party designated by them, other than the carrier, takes over the product.
7.4. The Consumer may also exercise their right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the product.
7.5. The direct cost of returning the product must be borne by the Consumer; the Service Provider has not undertaken to bear this cost.
7.6. In case of exercising the right of withdrawal, the Consumer shall not bear any costs other than the cost of returning the product.
7.7. The Consumer is not entitled to the right of withdrawal in the case of non-prefabricated goods produced according to the Consumer's instructions or express request, or in the case of products clearly customized for the consumer.
7.8. The Consumer also cannot exercise their right of withdrawal (full list of exceptions based on the decree, Section 29 (1)):
a) in the case of a contract for the provision of services, after the complete performance of the service, however, if the contract creates a payment obligation for the consumer, only if the performance has begun with the consumer's express prior consent and with the consumer's acknowledgment that they will lose their right of withdrawal once the business has fully performed the contract;

h) in the case of a service contract where the business visits the consumer at the consumer's express request for the purpose of urgent repair or maintenance;
i) regarding the sale of a copy of sealed audio or video recordings or computer software, if the consumer has unsealed the packaging after delivery;
j) regarding newspapers, periodicals, and magazines, with the exception of subscription contracts;
k) in the case of contracts concluded at a public auction;
l) in the case of a contract for the provision of accommodation, transport, car rental, catering or services related to leisure activities, with the exception of housing services, if a specific performance date or period has been stipulated in the contract;
m) regarding digital content provided on a non-tangible medium, if the business has commenced performance with the consumer's express prior consent, and the consumer, at the same time as giving this consent, declared that they acknowledge that they will lose their right of withdrawal/termination after the commencement of performance, and the business has sent a confirmation to the consumer as per Section 12 (2) or Section 18.
7.9. The Service Provider shall immediately, but no later than fourteen days from becoming aware of the withdrawal from the distance contract, refund the full amount paid by the consumer as consideration, including the costs incurred in connection with the performance. However, the Service Provider is entitled to a right of retention.
7.10. During the refund, the Service Provider will use the same payment method as used in the original transaction, unless the Consumer explicitly consents to the use of another payment method; the Consumer will not incur any additional costs due to the application of this refund method.
7.11. The Consumer must return or hand over the goods to the Service Provider without undue delay, but in no case later than 14 days from the date of sending the notification of withdrawal from the contract to the Service Provider. If the business also sells the goods in a physical store, and the consumer exercises their right of withdrawal in person at the business's physical store, they are entitled to return the goods to the business at the same time.
7.12. In the case of written withdrawal, it is sufficient for the Consumer to send the withdrawal statement within 14 days.
7.13. The Consumer meets the deadline if they return or hand over the product(s) before the expiry of the 14-day period. The return is deemed to have been made within the deadline if the Consumer sends the product before the expiry of the deadline.
7.14. The consumer bears only the direct cost of returning the product.
7.15. The Service Provider is not obliged to reimburse the Consumer for additional costs arising from the Consumer choosing a shipping method other than the cheapest standard shipping method offered by the Service Provider.
7.16. The Service Provider may withhold the refund until it has received the goods back or the Consumer has provided proof that they have sent them back: the earlier of the two dates shall be taken into account.
7.17. If the Consumer wishes to exercise their right of withdrawal, they can indicate their intention in writing (even using the attached statement), by phone, or in person at one of the Service Provider's contact details. In the case of a written notification, the date of posting/handing over to the courier/sending the email will be taken into account; in the case of a phone notification, the date of the phone call will be taken into account.
7.18. The Consumer is only liable for any depreciation in value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the product.
7.19. Government Decree 45/2014. (II.26.) on the detailed rules of contracts between consumers and businesses (hereinafter: R) is available here.
7.20. Directive 2011/83/EU of the European Parliament and of the Council is available here.
7.21. The Consumer may also contact the Service Provider with other complaints using the contact details provided in these Regulations.
7.22. The right of withdrawal applies only to Users who qualify as Consumers under the Civil Code.
7.23. The right of withdrawal does not apply to businesses, i.e., persons acting within the scope of their profession, independent occupation, or business activity.
7.24. (Applicable only if the Service Provider also provides services in addition to sales.)
If the Consumer terminates the distance contract after the commencement of performance, they must pay the business a fee proportionate to the service performed up to the time of notification of termination to the business. The amount to be paid proportionally by the Consumer must be determined based on the total amount of the consideration, including tax, as stipulated in the contract. If the Consumer proves that the total amount determined in this way is excessively high, the proportionate amount must be calculated based on the market value of the services performed up to the date of termination of the contract. When determining the market value, the consideration for the same service provided by businesses performing the same activity at the time of concluding the contract must be taken into account.
When exercising their right of withdrawal/termination, the consumer does not bear the following costs:
a) the full or partial costs of performing the service contract, if
aa) the business has failed to fulfill its information obligation stipulated in Section 11 (1) i) or k) of the R, or
ab) the consumer did not request the commencement of service performance as per Sections 13 and 19 of the R before the expiry of the deadline specified in Section 20 (2) of the R;
b) the full or partial costs of providing digital content on a non-tangible medium, if
ba) the consumer has not given their express prior consent to the performance commencing before the expiry of the deadline specified in Section 20 (2) of the R,
bb) the consumer, at the same time as giving their consent as per point ba), did not declare that they acknowledge that they will lose their right under Section 20 of the R, or
bc) the business failed to provide the confirmation stipulated in Section 12 (2) or Section 18 of the R.
7.25. Procedure for exercising the right of withdrawal:
7.25.1. If the Consumer wishes to exercise their right of withdrawal, they must indicate their intention to withdraw at one of the Service Provider's contact details.
7.25.2. The Consumer exercises their right of withdrawal within the deadline if they send their withdrawal statement before the expiry of the 14th day from the receipt of the product. In case of written withdrawal, it is sufficient to send the withdrawal statement within 14 days.
7.25.3. In case of withdrawal, the Consumer is obliged to return the ordered product to the Service Provider's address without undue delay, but no later than 14 days from the communication of their withdrawal statement, or hand it over to the service provider. The deadline is considered met if the product is sent before the expiry of the 14-day deadline (i.e., it does not have to arrive within 14 days). The customer bears the direct cost associated with the return of the goods due to the exercise of the right of withdrawal. If the business also sells the goods in a physical store, and the consumer exercises their right of withdrawal in person at the business's physical store, they are entitled to return the goods to the business at the same time.
7.25.4. However, the Service Provider is not obliged to reimburse the Consumer for additional costs resulting from the choice of a delivery method other than the cheapest standard delivery method offered by the Service Provider. The Consumer also exercises their right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the product.
7.25.5. In the case of multiple products, if the delivery of individual products takes place at different times, the buyer may exercise the right of withdrawal within 14 days from the receipt of the last product delivered, or in the case of a product consisting of multiple items or pieces, from the receipt of the last item or piece delivered.
WARRANTY, GUARANTEE
Faulty Performance
The Service Provider performs faultily if the service at the time of performance does not meet the quality requirements stipulated in the contract or by law. The Service Provider does not perform faultily if the authorized person knew of the defect at the time of concluding the contract, or should have known of the defect at the time of concluding the contract.
In a contract between a consumer and a business, any stipulation that deviates from the provisions of this chapter regarding implied warranty and guarantee to the detriment of the Consumer is null and void.
Several warranty rights are only available to Users who qualify as consumers under the Civil Code.
User classified as a business: a person acting within the scope of their profession, independent occupation, or business activity.
Implied Warranty
8.1. In what case can the User exercise their implied warranty right?
In the event of faulty performance by the Service Provider, the User may assert an implied warranty claim against the Service Provider according to the rules of the Civil Code.
8.2. What rights does the User have based on their implied warranty claim?
The User may, at their choice, exercise the following implied warranty claims: they may request repair or replacement, unless fulfilling the claim chosen by the User is impossible or would involve disproportionate additional costs for the business compared to fulfilling another claim. If they have not requested, or could not have requested, repair or replacement, they may demand a proportional reduction of the consideration or – as a last resort – withdraw from the contract. They may also switch from one chosen implied warranty right to another, but the User bears the cost of the switch, unless it was justified or the business caused it.
The Consumer is also entitled – commensurate with the severity of the breach of contract – to demand a proportional reduction of the consideration or to terminate the sales contract if
a) the business has not carried out the repair or replacement, or has carried it out but has not carried out the removal and re-installation in part or in whole, or has refused to bring the goods into conformity with the contract;
b) a repeated performance defect has occurred, despite the business's attempt to bring the goods into conformity with the contract;
c) the defect in performance is so severe that it justifies an immediate price reduction or immediate termination of the sales contract; or
d) the business has not undertaken to bring the goods into conformity with the contract, or it is evident from the circumstances that the business will not bring the goods into conformity with the contract within a reasonable period or without significant detriment to the Consumer.
If the Consumer wishes to terminate the sales contract citing faulty performance, the business bears the burden of proving that the defect is minor.
The Consumer is entitled to withhold part or all of the remaining purchase price – commensurate with the severity of the breach of contract – until the business fulfills its obligations regarding the conformity of performance and faulty performance.
The reasonable deadline for carrying out the repair or replacement of the goods must be calculated from the moment the Consumer notified the defect to the business.
The consumer must make the goods available to the business for the purpose of repair or replacement.
In the case of a contract between a consumer and a business, the business must ensure the return of the replaced goods at its own expense. If repair or replacement requires the removal of goods that were put into operation according to their nature and purpose - before the defect became apparent - then the obligation to repair or replace includes the removal of the non-conforming goods and the installation of the replacement or repaired goods, or bearing the costs of removal and installation.
The consideration is proportionate if its amount equals the difference between the value of the goods the Consumer would have received under a conforming performance and the value of the goods actually received by the Consumer.
The Consumer's right to warranty for termination of a sales contract can be exercised by a legal declaration expressing the decision to terminate, addressed to the business.
If the defective performance affects only a specific part of the goods supplied under the sales contract, and the conditions for exercising the right to terminate the contract exist with respect to those parts, the Consumer may terminate the sales contract only with respect to the defective goods, but may also terminate it with respect to any other goods acquired with them if the Consumer cannot reasonably be expected to keep only the goods conforming to the contract.
If the Consumer terminates the sales contract in whole or in respect of a part of the goods supplied under the sales contract, then
a) the Consumer must return the goods concerned to the business at the business's expense; and
b) the business must immediately refund the purchase price paid for the goods concerned to the Consumer, as soon as it has received the goods or proof of their return.
8.3. What is the deadline for the User to enforce their warranty claim?
The User (if considered a consumer) must report the defect immediately after its discovery, but no later than two months from the discovery of the defect. However, please note that warranty rights can no longer be enforced after the two-year (1 year for businesses or used products) limitation period from the performance of the contract has passed. (For products with an expiration date, the warranty can be enforced until the end of the expiration period).
In the case of goods containing digital elements where the sales contract provides for continuous provision of digital content or digital service for a specified period, the business is liable for any defect in the digital content or digital service of the goods if the defect
a) occurs or becomes apparent within two years from the performance of the goods in the case of continuous service for a period not exceeding two years; or
b) occurs or becomes apparent during the entire period of continuous service in the case of continuous service for a period exceeding two years.
8.4. Against whom can the warranty claim be enforced?
The User can enforce their warranty claim against the Service Provider.
8.5. What other conditions apply to the enforcement of warranty rights (if the User is considered a consumer)?
Within 1 year from the performance, there are no other conditions for enforcing a warranty claim beyond notifying the defect, provided the User proves that the product or service was provided by the business operating the webshop. After 1 year from the performance, however, the User is obligated to prove that the defect discovered by the User already existed at the time of performance.
Product Warranty
8.6. In what cases can the Consumer exercise their product warranty right and what rights are due to the Consumer based on their product warranty claim?
In case of a defect in a movable item, the Consumer may - at their choice - exercise their warranty right or enforce a product warranty claim according to the rules of the Civil Code.
As a product warranty claim, the Consumer may request the repair or replacement of the defective product.
8.7. Against whom can the product warranty claim be enforced?
Product warranty rights can be exercised against the manufacturer or distributor of the product (hereinafter collectively referred to as: manufacturer).
8.8. When is a product considered defective?
A product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics described by the manufacturer.
8.9. What is the deadline for the Consumer to enforce their product warranty claim?
The Consumer can enforce their product warranty claim within two years from the product being placed on the market by the manufacturer. After this deadline, this right is forfeited.
8.10. What rules of proof apply when enforcing a product warranty claim?
When enforcing a product warranty claim, you must prove that the product defect existed at the time the manufacturer placed it on the market.
8.11. In what cases is the manufacturer exempt from its product warranty obligation?
The manufacturer is exempt from its product warranty obligation if it can prove that
- the product was not manufactured or placed on the market within the scope of its business activity, or
- the defect was not discoverable at the time of its placement on the market according to the state of science and technology, or
- the defect of the product resulted from the application of a legal regulation or a mandatory official regulation.
The manufacturer needs to prove only one reason for exemption.
Please note that for the same defect, the Consumer can concurrently enforce a warranty claim against the business and a product warranty claim against the manufacturer. If the Consumer successfully enforced a claim arising from defective performance for a given defect (e.g., the business replaced the product), they can no longer claim on another legal basis for the same defect.
Warranty (for new durable consumer goods)
8.12. In what cases can the Consumer exercise their warranty right?
In case of defective performance, based on Government Decree 151/2003 (IX. 22.) on mandatory warranty for certain durable consumer goods, the Service Provider is obliged to provide a warranty if the user is considered a Consumer.
8.13. What rights and within what deadline are due to the Consumer based on the warranty?
The warranty period is:
a) two years for a selling price of 10,000 Forints or more, but not exceeding 250,000 Forints,
b) three years for a selling price exceeding 250,000 Forints.
Failure to meet these deadlines results in forfeiture of rights.
The warranty period begins on the day of delivery of the consumer article to the Consumer, or if the installation is performed by the Service Provider or its agent, on the day of installation.
If the Consumer has the consumer article installed more than six months after delivery, the start date of the warranty period is the day of delivery of the consumer article.
The Consumer may report their request for repair directly at the Service Provider's registered office, any of its premises, branch offices, and at the repair service indicated by the business on the warranty certificate, at their choice.
Based on a warranty claim, the entitled party may, at their choice
- request repair or replacement, unless the fulfillment of the chosen warranty right is impossible, or if it would result in disproportionate additional costs for the obligor – compared to fulfilling another warranty claim – taking into account the value of the service in its faultless state, the severity of the breach of contract, and the harm to the entitled party's interest caused by the fulfillment of the warranty right; or
- request a proportionate reduction of the consideration, or withdraw from the contract, if the obligor did not undertake the repair or replacement, cannot fulfill this obligation (...), or if the entitled party's interest in the repair or replacement has ceased.
Withdrawal is not possible for minor defects.
Aim for 15 days
Pursuant to Section 5 of NGM Decree 19/2014. (IV. 29.) on procedural rules for handling warranty and guarantee claims related to goods sold under contracts between consumers and businesses, the Service Provider shall endeavor to carry out the repair or replacement within a maximum of 15 days. If the duration of the repair or replacement exceeds 15 days, the Service Provider is obligated to inform the Consumer about the expected duration of the repair or replacement. This information shall be provided electronically or by other means suitable for verifying receipt by the Consumer, with the Consumer's prior consent.
If it turns out the product cannot be repaired
If, during the first repair of the consumer article within the warranty period, the Service Provider determines that the consumer article cannot be repaired, in the absence of a different arrangement by the Consumer, the Service Provider is obligated to replace the consumer article within 8 days. If replacement of the consumer article is not possible, the Service Provider is obligated to refund the purchase price to the Consumer within 8 days.
If the product breaks down for the fourth time
If, within the warranty period, the consumer article malfunctions again after three repairs, - in the absence of a different arrangement by the consumer - the business is obligated to replace the consumer article within eight days. If replacement of the consumer article is not possible, the business is obligated to refund the purchase price indicated on the warranty certificate, or in its absence, on the document presented by the consumer proving payment of the consideration for the consumer article - on an invoice or receipt issued under the law on general sales tax - to the consumer within 8 days.
If repair is not successful within 30 days
If the repair of the consumer article is not carried out by the 30th day from the communication of the repair request to the business, - in the absence of a different arrangement by the consumer - the business is obligated to replace the consumer article within 8 days following the unsuccessful expiry of the thirty-day deadline. If replacement of the consumer article is not possible, the business is obligated to refund the purchase price indicated on the warranty certificate, or in its absence, on the document presented by the consumer proving payment of the consideration for the consumer article - on an invoice or receipt issued under the law on general sales tax - to the consumer within 8 days following the unsuccessful expiry of the 30-day repair deadline.
The provisions of the above three clauses do not apply to electric bicycles, electric scooters, quads, motorcycles, mopeds, passenger cars, motorhomes, caravans, trailer caravans, trailers, and motorized watercraft.
8.14. When is the business exempt from its warranty obligation?
The Service Provider is exempt from its warranty obligation only if it proves that the cause of the defect arose after performance. Please note that for the same defect, the Consumer can concurrently enforce a warranty claim and a guarantee claim, as well as a product warranty claim and a guarantee claim. However, if the Consumer has once successfully enforced a claim arising from defective performance for a specific defect (e.g., the business replaced the product), they can no longer claim on another legal basis for the same defect.
8.15. The Service Provider is not liable for damages resulting from natural wear and tear/obsolescence beyond the warranty period (professionally expected lifespan).
8.16. Furthermore, the Service Provider is not liable for damages resulting from faulty or negligent handling, excessive use, or other influences deviating from the specified use, or other improper use of the products, after the risk of damage has passed.
8.17. If the Consumer enforces a replacement claim due to a malfunction of the consumer article within three working days from the purchase (or commissioning), the Service Provider is obligated to replace the consumer article, provided that the malfunction hinders its proper use.
8.18. What further requirements can be stipulated as conditions for exercising warranty rights?
Special requirements (e.g., periodic review) may be imposed on the consumer for the proper installation or maintenance of a consumer article, provided that proper installation or maintenance cannot be ensured otherwise, and compliance with the requirement does not impose a disproportionate burden on the consumer.
8.19. The list of consumer articles subject to mandatory warranty can be found here: 10/2024. (VI. 28.) IM decree on defining the scope of durable consumer goods subject to mandatory warranty
PROCEDURE IN CASE OF WARRANTY CLAIM
(FOR USERS QUALIFYING AS CONSUMERS)
9.1. In a contract between a consumer and a business, the agreement of the parties may not deviate to the detriment of the consumer from the provisions of Government Decree 19/2014. (IV. 29.) NGM on procedural rules for handling warranty and guarantee claims related to goods sold under contracts between consumers and businesses.
9.2. It is the Consumer's obligation to prove the conclusion of the contract (with an invoice or even just a receipt).
9.3. The costs related to the fulfillment of the warranty obligation shall be borne by the Service Provider (Civil Code § 6:166).
9.4. The Service Provider is obliged to record a protocol of the Consumer's warranty or guarantee claim reported to them.
9.5. A copy of the protocol must be made available to the Consumer immediately, in a verifiable manner.
9.6. If the Service Provider cannot state its position on the feasibility of the Consumer's warranty or guarantee claim at the time of its report, it must inform the Consumer of its position - in case of rejection, also of the reasons for rejection and the possibility of recourse to a conciliation body - within five working days, in a verifiable manner.
9.7. The Service Provider is obligated to keep the protocol for three years from its creation and to present it at the request of the inspecting authority.
9.8. The Service Provider shall endeavor to carry out the repair or replacement within a maximum of fifteen days. If the duration of the repair or replacement exceeds 15 days, the Service Provider is obligated to inform the Consumer about the expected duration of the repair or replacement. This information shall be provided electronically or by other means suitable for verifying receipt by the Consumer, with the Consumer's prior consent.
MISCELLANEOUS PROVISIONS
10.1. The Service Provider is entitled to use an intermediary to perform its obligations. It is fully responsible for the unlawful conduct of such intermediary, as if it had committed the unlawful conduct itself.
10.2. If any part of these Regulations becomes invalid, unlawful, or unenforceable, this shall not affect the validity, legality, and enforceability of the remaining parts.
10.3. If the Service Provider does not exercise a right due to it under these Regulations, the failure to exercise such right shall not be considered a waiver of that right. Any waiver of a right is valid only if expressly stated in writing. The fact that the Service Provider does not strictly adhere to any essential term or condition of the Regulations on one occasion does not mean that it waives its right to insist on strict adherence to that term or condition in the future.
10.4. The Service Provider and the User shall attempt to settle their disputes amicably.
10.5. The parties acknowledge that the Service Provider's webshop operates in Hungary, and its maintenance is also carried out here. As the site can be visited from other countries, users expressly acknowledge that Hungarian law is the governing law in the relationship between the user and the Service Provider. If the user is a consumer, then, pursuant to Section 26 (1) of the Code of Civil Procedure, the court having jurisdiction over the defendant's (Consumer's) domestic residence shall have exclusive jurisdiction in disputes arising from this contract with the Consumer.
10.6. The Service Provider does not apply different general access conditions regarding access to the products in the webshop for reasons related to the User's nationality, place of residence, or place of establishment.
10.7. The Service Provider does not apply different conditions for payment transactions - regarding the payment methods it accepts - for reasons related to the User's nationality, place of residence, or place of establishment, the location of the payment account, the place of establishment of the payment service provider, or the place of issue of the cashless payment instrument within the European Union.
10.8. The Service Provider complies with REGULATION (EU) 2018/302 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on addressing unjustified geo-blocking and other forms of discrimination based on customers' nationality, place of residence or place of establishment within the internal market and amending Regulations (EC) No 2006/2004 and (EU) 2017/2394 and Directive 2009/22/EC.

11.3. The business will examine verbal complaints immediately and remedy them as necessary.

11.5. The business shall provide the consumer with a copy of the protocol
a) in case of a verbal complaint communicated in person, on the spot,
b) in case of a verbal complaint communicated by phone or other electronic communication service, no later than simultaneously with the substantive response – unless the consumer has not provided all their data for handling the complaint, according to point 11.8.
11.6. The business is obligated to provide a unique identification number for verbal complaints communicated by phone or electronic communication service.
11.7. The protocol recorded about the complaint must contain the following:

g) the unique identification number of the complaint in case of a verbal complaint communicated by telephone or by using any other electronic communication service, and

11.9. The business shall respond to a written complaint in writing, substantively, and in a verifiable manner, and shall arrange for its communication within thirty days of its receipt, unless a directly applicable legal act of the European Union provides otherwise. A shorter deadline may be established by law, a longer deadline by an act of parliament. The business is obliged to justify its position rejecting the complaint.

11.12. In case of rejection of a complaint, the business is obliged to inform the consumer in writing about which authority or conciliation body's procedure they may initiate with their complaint, depending on its nature. The information must also include the seat, telephone and internet contact details, and mailing address of the competent authority or the conciliation body according to the consumer's place of residence, stay, or registered office. The information must also cover whether the business has made a general declaration of submission.
11.13. The business may omit to investigate repeated complaints with content identical to a previously substantively answered complaint, made by the same consumer, containing no new information, and consumer complaints made by an identifiable person.
11.14. We inform you that in case your complaint is rejected, you may initiate a procedure with an authority or a conciliation body, as follows (the Service Provider has not made a general declaration of submission):
11.15. The Consumer may turn to the consumer protection authority with a complaint:
According to Sections 45/A. (1)-(3) of the Fgytv. and Government Decree 326/2024. (XI. 14.) on the designation of the consumer protection authority, the government office acts as the general consumer protection authority: https://kormanyhivatalok.hu/kormanyhivatalok

11.17. The conciliation body is competent to settle consumer disputes out of court. The task of the conciliation body is to attempt to reach an agreement between the parties to settle the consumer dispute, and if unsuccessful, to make a decision in the case to ensure the simple, quick, efficient, and cost-effective enforcement of consumer rights. The conciliation body provides advice to the Consumer or the Service Provider upon request regarding the rights due to the Consumer and the obligations incumbent on the Consumer.
In the conciliation body procedure, in the absence of an agreement, the council decides on the merits of the case by
a) issuing a binding decision if
aa) the application is well-founded, and the business – recorded with the conciliation body or the chamber, or published in its commercial communication – has acknowledged the decision of the conciliation body as binding in its general declaration of submission under Section 36/C, at the beginning of the procedure or at the latest by the time of the decision, or
ab) the business has not made a declaration of submission, but the application is well-founded and the claim the consumer wishes to assert – neither in the application nor at the time of issuing the binding decision – does not exceed two hundred thousand forints, or
b) making a recommendation if the application is well-founded, but the business declared at the beginning of the procedure that it does not acknowledge the council's decision as binding, or if it did not declare anything at all about acknowledging the council's decision.
11.18. In the case of cross-border consumer disputes related to online sales or online service contracts, the conciliation body operated by the chamber designated by decree of the minister responsible for consumer protection is competent.
11.19. The business is subject to a duty of cooperation in the conciliation body procedure, within which it must send its response to the conciliation body with the content specified in the Fgytv. and within the deadline mentioned therein. With the exception of the application of Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC, the business must ensure the participation of a person authorized to reach an agreement at the hearing. In an online hearing, the representative of the business authorized to reach an agreement must participate online. If the consumer requests a personal hearing, the representative of the business authorized to reach an agreement must participate at least online in the hearing.
11.20. If the Consumer does not turn to a conciliation body, or the procedure does not lead to a result, the Consumer has the opportunity to turn to court to settle the dispute. The lawsuit must be initiated with a statement of claim, which must include the following information:
• the court having jurisdiction;
• the names, addresses, and litigation status of the parties and their representatives;
• the right to be enforced, with the facts forming its basis and evidence thereof;
• the data from which the court's jurisdiction and competence can be determined;
• a definite request for the court's decision.
The document, or a copy thereof, whose content is referred to as evidence, must be attached to the statement of claim.
